Drainage Problems and Complaints

One of the responsibilities of the Saskatchewan Watershed Authority by legislation and regulation is to respond to landowner concerns over drainage. The current legislation that applies includes:

Request for Assistance in Resolving a Complaint

Under section 80(1) of The Saskatchewan Watershed Authority Act 2005, a person who claims to have suffered, or anticipates that he or she may suffer injury, loss or damage by reason of the construction, extension, alteration or operation of any drainage works, must submit a written request for assistance in resolving the complaint.

The request is investigated and non-binding recommendations to resolve the problem are made by the Watershed Authority. If the parties are not able to accept the recommendation using this process, then a formal complaint can be made by the complainant under section 80 of The Act, which may result in a binding order against the person(s) responsible.

Examples of common complaints the Watershed Authority investigates include:

  • construction of a drainage ditch without a licence;
  • operation of a drainage ditch that results in a damage to the complainant's land;
  • diversion or potential diversion of floodwaters from one property to another;
  • lack of a culvert or a improperly sized or placed culvert through a roadway.
